During your initial consultation, we will talk about the facts of your case. I will give you my opinions if I am able. I may need to conduct legal research before I give you my opinions.
After the initial consultation, if you decide to retain me, you will sign a fee contract. The fee will be contingent, hourly or flat depending on the nature of your legal issue. You will receive a copy of the fee contract. Personal injury cases are generally done on a contingency fee basis.
As your case progresses, you may need to provide me with documents, the names of witnesses and other information. I will keep you updated on the progress of your case. Periods of time may pass when you do not hear from me. During these periods, we may be waiting for additional information or a response from another person. I will have nothing new to tell you. If we cannot solve your legal problem without filing a lawsuit, then we will discuss filing a lawsuit. If one is filed, your case will proceed through the court system. Most people find participating in a lawsuit unpleasant. I will try to make it as easy as possible for you.
Sometimes an expert or experts are required to testify in a lawsuit. Experts are individuals with a background, training and experience in a particular area. Physicians are experts, as are engineers. Experts are required when facts or opinions are not within the general knowledge of individuals. If you are a plaintiff in a case, you have the burden to prove every element or part of your claim. You may need an expert to testify for this purpose. Defendants often use experts to contradict experts testifying on behalf of plaintiffs.
During your representation, we will discuss the possible settlement of your case and the trial of your case. We will discuss the strengths and weaknesses of both parties’ positions, the costs involved in taking the case to trial and your options. We will reach a decision and move forward to a resolution of your case.
